The picture is to small to really see the scorpion. It appears to be what is called a Brown Scorpion but I am really not sure. One way to tell if they are poisonous is by looking at the pinchers. The smaller the pinchers, generally the more hazardous the scorpion. Really large pinchers generally indicate a less toxic venom, although any scorpion sting will hurt.

I tried to crop the photo and resend, but it wont let me from this response window. The pinchers seem pretty big in relation to the size for the scorpion, maybe about 1/3 of it's "arm". Located in Las Vegas NV.
